In this Policy, unless the context otherwise requires:

"Site/application" means the GOEC website, mobile Application, media channel, related link, or otherwise connected to GOEC.

"Applicable Law" means the Digital Personal Data Protection Act, 2023 (the "DPDP Act"), the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and any other law, rule, regulation, or notification applicable to the processing of personal data in India, as may be amended from time to time.

"Company", "we", "us", or "our" means GOEC.

"Third Party" means any natural person, company, organisation, authority, or entity other than the User, the Company, and persons authorised to process personal data on behalf of the Company. Third parties may include service providers, business partners, regulatory authorities, and other entities with whom personal data may be shared in accordance with this Privacy Policy and applicable laws.

"Data Fiduciary" and "Data Principal" have the meanings assigned to them under the DPDP Act.

"Personal Data" means any data about an individual who is identifiable by or in relation to such data.

"User", "you", or "your" means any individual who accesses, downloads, installs, registers on, or otherwise uses the Platform, including Electric vehicle users, guest users, registered account holders, technicians, administrators or business customers.

"User Content" means any information, data, text, images, videos, audio recordings, identification details, user contact information, chat and call history during communication for customer support, responses to surveys or questionnaires, documents submitted to support requests or verification, screenshots and attachments provided during customer service interactions, location-related submissions, vehicle details including EV Model, registration number, battery specifications, payment preferences, charging preferences or charging schedules.

This Policy applies to all Personal Data and other information collected by GOEC through its Site/Application, regardless of the device or means used to access it. This Policy does not apply to information collected by any third party, including any third-party website, application, or service that may be linked to or accessible through the Platform. We encourage you to review the privacy policies of any third-party service before providing your information to them.

We collect information in the following categories:

3.1. Information You provide to Us

When you register for, access, or use Our Site/Application, we may collect:

• Full name, contact number, vehicle details like vehicle registration number, Vehicle model;
• Mobile phone number and email address;
• Address, city, state, and location details;
• Photographs, images, videos, audio recordings, and documents uploaded by you;
• Ratings, reviews, comments, and feedback;
• Payment, billing and transaction information relating to User e-wallet recharge, credits, and offers; and
• Any other information you choose to provide through your User Account, communication, or customer support requests.

3.2. Information Collected automatically

We may receive information about you from:

• Device information, including device identifiers, device type, operating system, and mobile network information;
• GPS and location data, to enable location-based matching and services;
• Application usage information, including features accessed, time spent, search history, and interaction patterns;
• Vehicle information, including vehicle type and category, model, make, variant, year of manufacture, fuel type, ownership status, vehicle photographs, and vehicle-related information provided through the Site/application. We may also automatically collect information relating to the use and operation with the Platform, including location data, route information, trip history, travel distance, speed, timestamps, service availability status, vehicle activity records, and other telemetry or operational data generated through the use of the Mobile Application and associated device permissions;
• Log data, including IP address, access times, pages viewed, and crash reports;
• Call metadata, including call logs and duration of voice and video calls facilitated through the Site/application, but not the content of such calls unless expressly disclosed or required by law; and
• Information collected through cookies, analytics tools, and similar technologies, as described in Section 10 below.

3.3. Information collected from Third Parties

We may receive information about you from:

• Payment gateway providers, for the purpose of processing transactions;
• Original vehicle manufacturer and their affiliated connected vehicle platforms may share information relating to the User;
• Other Users of the Platform, such as ratings, reviews, or communications relating to you; and
• Publicly available sources, where permitted by applicable law.

We collect and use your information for the following purposes:

• to create, verify, and maintain your profile and account on the Site/application;
• to provide, operate, maintain, and improve the Site/application and related services;
• to facilitate connections, communications, transactions, and interactions between users, supporting staff, employees of the Company, associated service providers, original vehicle manufacture on the Site/application;
• to verify user identity, credentials, licences, certifications, vehicle details, and other information required for access to or use of the Site/application;
• to process registrations, credits, e-wallet recharge, payments, and other transactions;
• to process and enable the smooth and convenient charging of the electric vehicle;
• to provide customer support, respond to enquiries, investigate complaints, resolve disputes, and enforce our Terms of use;
• to send service-related notifications, alerts, confirmations, updates, reminders, security notices, and administrative communications;
• to personalize user experience, content, recommendations, advertisements, and services based on user preferences, location, activity, and interactions with the Site/application;
• to monitor, analyze, and understand usage patterns, trends, and user behaviour for business intelligence, research, analytics, and service improvement purposes;
• to detect, investigate, prevent, and address fraud, unauthorized access, security incidents, abuse, illegal activities, and violations of applicable laws or our policies;
• to verify and maintain the safety, reliability, and integrity of the Platform and its users;
• to comply with applicable laws, regulations, court orders, governmental requests, legal processes, and regulatory requirements;
• to protect our rights, property, business interests, Users, and the public;
• to communicate promotional offers, marketing communications, surveys, newsletters, and information about products, services, events, and opportunities, where permitted by applicable law; and
• for any other purpose disclosed to you at the time of collection or otherwise permitted under applicable law.

By downloading, installing, registering for, or using the Site/application, you provide your free, specific, informed, and unambiguous consent to the collection, use, storage, sharing, and processing of your Personal Data for the purposes described in this Policy, in accordance with the DPDP Act.

Where required by Applicable law, we will seek your explicit consent before collecting or processing sensitive categories of information, including personal information, call recordings, etc. You may withdraw your consent at any time by writing to us at the contact details provided in Section 14 below; however, such withdrawal will not affect the lawfulness of any processing carried out prior to the withdrawal, and may limit or prevent your continued access to certain features of the Site/application.

We do not sell your Personal Data. We may share your information in the following circumstances:

6.1. With Service Providers

We may share information with third party vendors, contractors, and service providers who perform services on our behalf, including payment gateway providers, cloud hosting providers, analytics providers, etc. Such parties are bound by confidentiality and data protection obligations consistent with this Policy and Applicable law.

6.2. For legal and Regulatory Providers

We may disclose information where required by Applicable Law, or in response to a valid request from a court, tribunal, government authority, or law enforcement agency, or to protect the rights, property, or safety of GO EC, our Users, or the public.

6.3. In connection with Business Transfers

In the event of a merger, acquisition, reorganisation, or sale of all or part of our business or assets, your information may be transferred as part of that transaction, subject to Applicable law.

6.4. With Your Consent

We may share your information with other third party where you have given your explicit consent to do so.

We retain your Personal Data only for as long as necessary to provide the Site/application and its services, comply with our legal obligations, resolve disputes, prevent fraud, and enforce our Terms of use. Specific retention practices for categories such as chat history, call history, deleted accounts, payment history, etc are set out in the GO EC terms of use, which form part of this Policy by reference.

You may request deletion of your account and Personal data at any time through the account settings available on the Site/application or by writing to us at the Contact details in Section 14. Upon receipt of a valid request, we will delete or anonymise your Personal Data within a reasonable period, except where retention is necessary or permitted under Applicable Law, including for compliance with legal obligations, resolution of disputes, prevention of fraud, or enforcement of our Terms of Use.

We implement reasonable administrative, technical, and organizational safeguards designed to protect your Personal Data against unauthorized access, use, disclosure, alteration, loss, misuse, or destruction. These safeguards include identity verification mechanisms, access controls, encryption where appropriate, and secure storage practices, consistent with the DPDP Act and prevailing industry standards.

No method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for taking reasonable precautions to protect your account.

In the event of a Personal Data breach affecting your information, we will take appropriate steps to investigate and remediate the breach and will notify you and, where required, the relevant regulatory authority, in accordance with Applicable Law.

The Site/application may use cookies, device identifiers, software development kits, analytics tools, and similar technologies to enhance your experience, understand usage patterns, and improve the Site/application. You may control or disable certain tracking technologies through your device or browser settings; however, doing so may affect the availability or functioning of certain features of the Site/application.

The Site/Application may request access to your device location, and microphone in order to provide location-based matching, identity verification, and communication features such as voice calls and video calls. You may grant, decline, or withdraw such permissions at any time through your device settings. If you decline or withdraw any required permission, certain features of the Site/Application may become unavailable, limited, or unable to function as intended, and GO EC shall not be liable for any resulting loss of functionality.

This Site/application is intended solely for individuals who are eighteen years of age or older. We do not knowingly collect Personal Data from individuals below eighteen years of age. If we become aware that we have inadvertently collected Personal Data from a minor, we will take reasonable steps to delete such information promptly, in compliance with the DPDP Act.

Subject to Applicable Law, you have the right to:

• access and obtain a summary of the Personal Data we hold about you;
• request correction or updating of inaccurate or incomplete Personal Data;
• request erasure of your Personal Data, subject to our legal retention obligations;
• withdraw your consent to processing at any time;
• nominate another individual to exercise your rights in the event of your death or incapacity, as permitted under the DPDP Act; and
• register a complaint with us, and thereafter with the Data Protection Board of India, where applicable.

This Policy does not apply to the privacy practices of such third parties, and GO EC is not responsible for their content, accuracy, or privacy practices. GO EC communicates with Users only through its official application, website, verified email addresses, and verified social media accounts. We will never ask you to share your account password, OTP, or banking details through unofficial channels. Please refer to the fraud prevention provisions of our Terms and Conditions for further guidance, and report any suspicious communication to us immediately.

We may amend or update this Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. Any material changes will be notified to you through the Site/application, by email, by SMS, or through in app notification, in accordance with the notice provisions of our Terms and Conditions. Your continued use of the Site/application following any such update constitutes your acceptance of the revised Policy.

This Policy shall be governed by and construed in accordance with the laws of India, including the Digital Personal Data Protection Act, 2023, and any dispute arising in connection with this Policy shall be subject to the dispute resolution and jurisdiction provisions set out in the GO EC Terms and Conditions.
